The Supreme court Thursday upheld the election of President Bola Tinubu.
The Independent National Electoral Commission (INEC) had declared Tinubu of the All Progressives Congress (APC) winner of the February 25 presidential election.
However, dissatisfied by Tinubu’s declaration, Atiku Abubakar of the Peoples Democratic Party (PDP) and Peter Obi of Labour Party held to the Presidential Election Petition Tribunal (PEPT) to challenge his victory.
But the tribunal in its judgement upheld the victory of the President.
Following the judgement of the tribunal, both Atiku and Obi appealed the judgment at the Supreme court.
The Supreme Court said it lacks jurisdiction to accept fresh evidence.
The Supreme court further held that non transferring of election results to the INEC Results Viewing (IREV) portal does not nullify the elections.
The court added that the Electoral Act does not specify the manner by which elections could be transferred, adding that it is the prerogative of INEC to determine the method it wishes.
The supreme court added that Atiku and Obi failed to prove that there was non compliance in the February 25, 2023 presidential election, stressing that their witnesses were collation officers and not polling agents.
The Supreme court said it is the agents that could attest to any anomaly in an election because they were the ones who witnessed election at polling units.
